Kashmir issue is an international issue and deserves to be settled by holding a free, fair and impartial plebiscite under the UN auspicious in accordance with the standing UN resolutions dated 13.08.1948 and 05.01.1949 on Kashmir. The people of Jammu and Kashmir are fighting a freedom war and seek resolution of Kashmir dispute in accordance with the wishes and aspirations of the people. There can be no substitute to the freedom which is the cherished goal of the people’s struggle in Jammu and Kashmir. National Conference and PDP are pursuing a political recourse to change the direction of the freedom struggle by playing slogans of internal autonomy and self rule.
The National Conference and PDP are in political efforts to change the direction of the movement likewise the Ex-Governor of Jammu and Kashmir Giresh Chander Sukseena promised to change the direction of the gun from the war against India towards the people of Jammu and Kashmir. Bar association advise both these organizations to desist from pursuing these efforts.
Jammu and Kashmir is a disputed territory and the Indian claim of Kashmir being integral part of India is baseless and unfounded in history, politics and diplomacy. The Govt. of India is commuted at international to have accepted Jammu and Kashmir as a disputed territory and resolve the Kashmir issue through peaceful means. On 26th January when Indian Govt. is observing the way as Republic Day, the same day is a Black day for the people of Jammu and Kashmir as the Indian Govt. has deprived the people of Jammu and Kashmir from the freedom and democratic rights past 63 years.
At this stage the Jammu and Kashmir high Court Bar Association advises Govt. of India and the people of India to realize the seriousness and sensitivities involved in the Kashmir dispute and the Govt. of India should resume a purposeful and comprehensive dialogue process with Govt. of Pakistan for resolution of Kashmir dispute by implementing UN resolutions. Jammu and Kashmir High Court Bar Association feels the people of Jammu and Kashmir are fair and justified in observing the republic day of India on 26th of January as a Black Day. Bar Association accordingly appeals the people of Jammu and Kashmir to observe the general strike on 26th of January 2010 and shall remain away from official functions on this day.
